Annual Leave and Sick Leave in a Small UAE Café Team

In a café with three baristas, leave is not an HR topic. It is a rota problem with a legal floor underneath it. One person away for a month means the other two absorb roughly a third more work, or you pay someone else to, and that usually happens in the same month the leave salary goes out. Owners who get caught by this are rarely the ones who refused leave — they are the ones who never wrote down who was taking what, and found out in July that two of the three wanted the same four weeks.

How much annual leave is your barista entitled to?

The private-sector minimum under the UAE labour law is 30 calendar days of paid annual leave for each completed year of service. For someone who has finished six months but not a full year, the entitlement accrues at two calendar days per month. Below six months, leave is at your discretion rather than an entitlement, which does not mean it is a good idea to refuse it.

Two details matter more to a café than the headline number. The first is *calendar* days: the count is not working days, so weekly rest days and public holidays falling inside the leave period sit inside the 30 rather than extending them. The second is the wage the leave is paid at, which the law works from the basic wage rather than the full package — so how your contract splits basic pay from allowances changes what a month of leave actually costs you. Both are worth confirming for your own contracts with MOHRE or your PRO before you promise anything, and the same goes for carry-over and payment in lieu, which is where most disputes actually start.

What about sick leave?

Sick leave is the one that arrives with no notice, and it works on a sliding scale. After the probation period, an employee is entitled to up to 90 days of sick leave per year of service, continuous or not, paid as full pay for the first 15 days, half pay for the next 30, and unpaid for the remaining 45. During probation there is no entitlement to paid sick leave, though you may grant unpaid leave on a medical report from a recognised authority.

Three things follow from this that are easy to get wrong in a small business. A certificate from an approved provider is the basis of the whole thing, so ask for one every time and keep it on file. You cannot serve notice on someone while they are on sick leave. And an illness the employee brought on themselves through misconduct is treated differently. If a case looks like it is heading anywhere near termination, get advice before you act rather than after.

Covering the rota when one of three is away

The arithmetic is unforgiving in a small team, so do it before you approve anything. Look at your hourly sales and find the hours you genuinely cannot run with one fewer pair of hands — for most cafés that is a two-hour morning peak and, if you do food, the weekend middle of the day. Everything else is negotiable. Then pick your cover method deliberately rather than by default:

  • Shorten the opening hours you can afford to shorten. Closing an hour earlier for three weeks is cheaper than overtime, and quieter than a badly covered peak. Check what that hour actually earns first — what your opening hours are really worth is the calculation.
  • Train for overlap before you need it. If only one person can run the espresso machine well, that person can never take leave without the coffee getting worse. Cross-training is the cheapest leave cover there is.
  • Keep one trained part-timer you actually call. Someone who works a shift a fortnight stays current. Someone you call once a year is a stranger behind your till.
  • Take the shift yourself, but count it. Owner hours are real labour cost even when nobody invoices for them, and pretending otherwise makes the month look better than it was.

Plan leave around the UAE year

A café here has a shape to its year, and leave should follow it. The deep summer is when trade is slowest in most locations and when a lot of staff want to travel home anyway — those two facts are an opportunity, not a coincidence. The cooler months, Ramadan, Eid and the school holidays pull the other way: high trade, high demand for time off, and in Ramadan a working day that is shorter by law. Practically: ask for leave preferences once, in writing, a few months before the quiet season. Publish who has what. Cap how many people can be away at the same time, and say the number out loud — in a team of three it is one. Keep a leave record you could hand to someone

Keep one file per employee holding the signed contract, every leave request and approval, every medical certificate, and a running balance of days taken. It is boring and it takes ten minutes a month.
